When is a person considered a Spanish resident?

A person is considered a resident in Spain when he either stays in Spain for more than 183 days during the calendar year, or has the main centre or base of his economic activities or interests, directly or indirectly, in Spain.

A person will also be considered to have his main residence in Spain when his spouse who is not legally separated and his dependent minor children habitually reside in Spain.
Notwithstanding the above, those who, due to their position, have to travel to another country to carry out their work, such as members of Spanish diplomatic missions, or who are part of delegations or observer missions abroad, will be considered residents in Spain despite residing in another country.
Tax residence is accredited by a certificate issued by the Tax Authority of the country in question. The validity period of these certificates extends to one year.
